Important FHA Changes Effective April 1, 2012

HUD has announced a change in the UFMIP and annual premium percentage effective with case numbers assigned on or after 4/1/12. The UFMIP will be increased from 1% to 1.75% regardless of the loan term or ltv ratio. The annual mortgage insurance premium will also increase .10%.
The new premium structure will be:

Loan Terms > 15 Years

UFMIP – 1.75%
Monthly - =< 95% - 1.20%
>95% - 1.25%

Loan Terms =< 15 Years

UFMIP – 1.750%
Monthly - =< 78% - none
78.01 – 90% - .35%
> 90% - .60%

EXAMPLE FOR $200,000 BASE LOAN AMOUNT

Current UPMIP = $2,000 After 4/1/12 = $3,500
Current Monthly MIP = $191.67 After 4/1/12 = $208.33

Current Total Payment (at today’s rate of 3.75%) = $1,127.16
Total Payment after 4/1/12 (at same rate) = $1,150.77

In this scenario the total payment is increased by $23.61/mo.

Stage 3 Water Restrictions for City of Rowlett

Stage 3 Water Restrictions Implemented November 1, 2011
The City of Rowlett purchases water from the North Texas Municipal Water District (NTMWD). The current drought continues to impact the lakes that supply the NTMWD, including:

Lake Lavon (49% full as of 10/28/2011)
Lake Texhoma (77% full as of 10/28/2011)
Lake Chapman (33% full as of 10/28/2011)
Lake Tawakoni (72% full as of 10/28/2011)

Due to dangerously low lake levels, Stage 3 Water Restrictions are implemented on November 1, 2011.

Water Restrictions
City Ordinance ORD-021-09 requires citizens:
Limit landscape watering with sprinklers or irrigation system to once every seven days corresponding with residents trash pick up day (see map).
Foundations, new landscaping, new plantings (first year) of shrubs and trees may be watered for up to two hours on any day by a hand-held hose, a soaker hose or a dedicated zone using a drip irrigation system.
Wait until the current drought has passed before establishing new landscaping and no hydroseeding, hydromulching or sprigging allowed.
Do not drain and refill swimming pools except to replace normal water loss.
Halt non-essential City government water use including street cleaning, vehicle washing, operation of ornamental fountains, etc.*

* Waterview Golf Course utilizes untreated water from a separate City of Dallas (Lake Ray Hubbard) agreement and will not be subject to Stage 3 Water Restrictions.

WHY IS THIS THE BEST TIME IN HISTORY TO BUY A HOME??? Here are some Positive Trends for you to track…

1. Rental vacancy rates are at their lowest since 2003 and still falling, which will drive up rents even faster than the 2-3 percent average annual increase predicted earlier this year. Moreover, with demand outpacing supply, the rent-to-buy equation is turning increasingly favorable in markets across the nation.

2. National average home prices in June were still 7.9% below a year ago, which was the height of the boom spawned by the tax credit. However, prices are still up 4.1% over the first quarter. Those are the cautionary findings from Clear Capital’s second quarter report, which is based on data from fair market and REO transactions from recorder and assessor’s offices as well as market reports.

3. The mortgage delinquency rate has fallen for the sixth consecutive quarter, reports TransUnion. The share of borrowers at least 60 days late on their payment fell to 5.82% this spring, compared to 6.67% a year ago.

4. One of the biggest bright spots in the housing market is housing affordability which is near an all-time high in 2011 according to the National Association of Realtors. Falling prices have made homes affordable. The trade group’s affordability index measured the third-highest on record after the first quarter of 2011 and the fourth quarter of 2010. Record keeping began in 1970.

How a Credit Score Is Affected

FICO evaluated three various scenarios of mortgage holders — a borrower with a great credit score (780), a borrower with good credit (720), and a poor credit borrower (680) — in a study it conducted last month. Here’s the impact FICO found:

▪ 30 days late on a mortgage payment: The 780 credit score borrower has her credit score fall to 670-690. The 720 credit score borrower has his fall to 630-650. The 680 credit score borrower falls to 600-620.
▪ Short sale, deed in lieu of foreclosure, or settlement, assuming the balance has been wiped out: The 780 credit score borrower falls to 655-675; the 720 credit score falls to 605-625; and the 680 credit score drops to 610-630.
▪ Foreclosure, or short sale with a deficiency balance owed: The 780 credit score drops to 620-640; the 720 credit score falls to 570-590; and the 680 credit score decreases to 575-595.

Exciting News Regarding Credit Score Requirements

Coldwell Banker Home Loans has lowered the minimum credit score requirements for FHA, VA and USDA loans!

For Maximum financing on FHA loans, a minimum credit score of 600 is now required instead of 620. We are also offering financing on FHA loans with 10% down with credit scores down to 500. There are specific requirements on the loans with credit scores under 600, so please make sure that your clients contact us regarding approval.

VA minimum credit score requirements for maximum financing have been lowered to 600! 10% down required down to a 580 credit score!

USDA minimum credit score requirements are now 580! There are a lot of specific requirements for this loan in general, so make sure that your buyer meets these requirements by getting them approved with me.

First-time home buyers once set out to buy a "starter home," which refers to an entry-level property that is affordable and often needs some updating. But new buyers are forgoing the "room for improvement" home, and are getting more choosy in their home shopping.

87% of first-time home buyers said they want to purchase a home that is move-in ready, according to a survey from Coldwell Banker Real Estate. First-time home buyers made up half of the market in 2010, according to the National Association of Realtors.

Sold in 44 Days Amongst Stiff Competition

A home owner who lives in Florida and owns a property in North Texas contacts me through Facebook (Realtor-Rochelle Fitzgerald) and asks: "PLEASE sell my house. But it is in Sherman, TX." Wow, ok, but that is about a 1 hour drive for me. And there are 16 homes for sale in the neighborhood. That is a lot of competition!!

It took the seller 2-weeks to complete the suggested repairs before the home was ready for marketing. So to make a long story shorter.... this property received 1 showing. Only one showing! And an offer was received at 39 days on the market. After a few days of negotiating, the seller sold his home at 44 days on the market!!! 16 properties are still available for sale in that subdivision. But what is important is that his home is not one of those.

Here is what he posted on his Facebook:

'Breaking News: I accepted an offer on our house in TX today. It was on the market for only 44 days (including the Holidays) and competed with 16 properties in the neigborhood. The trick? It is the first time HGTV has presented a reverse offer on television!! And I am privileged and honored to be the Realtor to educate the public about this negotiation technique.

Why Do Brokers Charge Different Commissions?

Thank you Mr. and Mrs. Seller for asking such a wonderful question. I get asked this all the time when visiting sellers. Mainly, the concern is "why should I use you when I can get a cheaper commission with your competitor?". Though the answer is based upon individual circumstances. I will try to answer this to fit all.

Some of the larger brokerages do not allow commissions to be reduced because the services offered are unmatchable and high quality. With proven track records and producing higher list to sold prices, there is no reason to reduce a fee that has to cover the cost of doing business.

Many of the smaller brokerages reduce fees to get more business to cover their cost of doing business. They offer limited marketing, marketing of lesser quality and offer less services. Which typically means that your DAYS ON MARKET IS LONGER and you typically receive a lesser sold price (the $$ in your pocket).

A broker that only charges to list your property (Limited Service) only does just that. You are given no service at all. Kinda like walking up to a coffee bar and making your own coffee versus going to Starbuck and ordering to your specifications. Or going to the coin carwash and washing your own car for 2 hours versus driving into a carwash to have them clean and detail your car in 20 minutes. You get what you pay for.

Selling your home is the BIGGEST DOLLAR TRANSACTION you will ever have. Get the best representation, get the best advice, get the best service, get the best marketing and get the best price for selling your home. Pay for what you want and you will have more $$ in your pocket!!

Sellers? Have You Considered Owner Financing?

As a seller, you want to appeal to as many buyers as possible. I understand that. And since you are financially stable, you want to offer owner financing. I understand that too. It has been done for many years and you feel you can assist a buyer improve their credit. Well, hold on to your hat, because times have changed!

President George W. Bush signed into law the Secure and Fair Enforcement for Mortgage Licensing Act (SAFE Act) on July 30, 2008, to be implemented within one year. The State of Texas implemented the SAFE Act into legislation in 2009. Included in this law is a small provision that requires a seller financing a one-to-four-family residential transaction involving property other than your primary residence (homestead) to now be licensed as a Residential Mortgage Loan Originator (RMLO).

The only two exemptions to this law is if the seller is seller-financing their personal, primary homestead or if the seller is extending financing to a family member.

To be clear, seller financing is still allowed in Texas, but the seller has to be a licensed RMLO or meet one of the exemptions noted above.

Are you dealing with an informed real estate agent that will keep you out of legal trouble?

Buyers? Is Seller Financing An Option?

So let us, for the sake of argument, say that you are unable to secure a home loan with a mortgage broker or banker. You have a good job history, make good money and have saved money for a decent down payment, the problem is your credit scores. Can you purchase a home using seller financing?

The answer is yes. But buyer beware!

Issue #1:

A seller that is offering seller-financing is now required by law to be a licensed Residential Mortgage loan Originator (RMLO). The only two exemptions to this rule is if the seller is seller-financing their personal property (homestead) and if the seller is extending financing to a family member.

To be clear, seller financing is still allowed in Texas, but the seller has to be a licensed RMLO or meet one of the exemptions noted above.

Don’t get suckered into something illegal because someone may un-intentionally be taking advantage of your poor credit. Simply contact a credit repair company to assist you in repairing your credit. Some situations can take 4-6 months to repair, others may take longer. Contact me for a reputable company.

Issue #2:

If the seller has a mortgage on the property and defaults on the loan, guess who is out of the down payment and lease? That is right… you. You do not control the mortgage payment (which is a mortgage agreement between the mortgage banker/broker and the seller) therefore you cannot control the seller-financing for the term of the agreement. What protection do you and your money have? None!

If your credit scores are too low to secure a mortgage loan, be patient. Simply contact a credit repair company to assist you in repairing your credit. Some situations can take 4-6 months to repair, others may take longer. Contact me for a reputable company.

A home owner contacted me because his investment property was having trouble. Trying to attempt a short sale on his own was a mind blowing experience. Since his lender instructed him to get representation by means of a realtor, not only was I up for the job, but I sold it in 35 days. I laugh (after the fact) at the feedback from the seller regarding his experience:

"Our home was compared to a ship in a storm, taking on water. You came in as our captain and right-sided the ship and sailed it through rough waters into calmer seas all the way to the dock. The transaction closed, which means we are now on the beach drinking pina coladas."

LOL... I have never heard such a description of my job performance, but you know I will take it! I just loved this and thought I would share it. Now let me get a pina colada, I'm thirsty.

Credit Inquiries and Credit Scores Information

When a consumer makes a credit inquiry for a mortgage, typically their credit score will drop approximately 5 points. All customers want the best rate and deal, but not at the expense of hurting their credit.

Many consumers are fearful to have a second or third lender pull their credit because it is thought that this would lower their credit score even more with each inquiry. This is not entirely true. To compensate for this, the 3 major credit bureaus (Experian, Trans Union and Equifax) ignore mortgage, auto, and student loan inquiries made within the 30 days of your initial inquiry. So, if you find a loan and a lender within 30 days, the inquiries won't affect your score while you're rate shopping.

Gary asked: What is the difference between tax appraised value and market value of a home? What does that have to do with my list price or purchase price?

Appraised value is the tax value that the County, City and School taxes are based upon. An inspection of the home is not necessary. Taxes can be higher or lower than the fair market value.

Fair market value is the price a buyer will pay and a seller is willing to accept. This amount can change with the real estate market. An appraisal or a market analysis will determine the fair market value of a property.

Relevance to list price or purchase price? The amount a seller needs to pay off the loan or the amount a buyer is able to afford does not affect the value. It is what it is.

Congrats to Christian for purchasing his first home. Christian decided to take advantage of the Federal Tax Credit by purchasing a home on Lake Ray Hubbard. Christian will receive $8,000 from the IRS to do as he so pleases. $8,000 could buy furniture, golf cart, towards a sail boat or just sit in the bank. The most important thing is that Christian is now a home owner!

The Federal Tax Credit is available until April 30, 2010. Any purchase must be under contract by April 30, 2010 and closed by June 30, 2010. This includes new builds.

Searching for or selling a home in November or December does not have to be stressful during the holiday frenzy. These simple tips for buyers and sellers can minimize stress and possibly facilitate a sale.

SELLERS:

Less is more when decorating a home for the holidays while you are trying to sell. Streamline the amount of holiday specific decorations you display.
Large over-size Christmas trees and other holiday decorations consume space that might make rooms or landscapes appear smaller.
Turn off animated holiday decorations before showings, buyers should focus on your home and not your decorations.
If you are having out-of-town house guests, ask your real estate agent to postpone showings until after your guests depart.
Display summer photos of home and gardens to inform buyers of the features of the home in other seasons. Holiday buyers are serious shoppers.

BUYERS:

You can find motivated sellers at year-end, but don't think they'll give away their home. Do your homework before drafting an offer. Look only at sold comparable's from the last six months.
Patience rules at the holidays. Everyone is busy, and if it takes an extra day to view a property, it's not uncommon.

BOTH:

If you plan to close the purchase or sale of a home near a holiday, check with your agent, title company and lender to verify two business days before closing that they have all the required documents and funds have been wired to complete the transaction.
If you are closing on your new home, select a mid-week day, early in the day, to schedule your closing time, to accommodate last minute delays by a mortgage loan processor, insurance or title company – especially during the holidays.
If you plan to move during the holidays, keep in mind that moving companies will require more notice and could charge additional fees for packing, moving and delivering household goods on week-ends and holidays.

Answer: Yes. Be sure to have your own representation. Walking into the door without your Real Estate Consultant means that the sales agent represents the builder and the builders money. A sales agent is not a Licensed Texas Realtor! So the sales agent is not required to give you necessary details of the contract IF you don't ask.

Your Real Estate Consultant has a business relationship with most builders and know which builders will negotiate and provide builder incentives. Your Real Estate Consultant also represents your needs regarding the build and any issues before and after closing.

Your Real Estate Consultant should be the FIRST person you contact when you are driving around on a Sunday looking at new properties.

Can I Purchase a Home For $100 Down?? Yes!

Mr Out-of-Towner inquired about a property within another city that is a HUD foreclosure. (A HUD foreclosure is a property that the government owns.) Though another agent was assisting Mr. Out-of-Towner, Mr. Out-of-Towner contacted me, his real estate consultant, to receive detailed information about the purchasing process that could assist him with his real estate decisions. After a little research, I informed Mr. Out-of-Towner that if he were to purchase this approved HUD foreclosure and finance the loan through FHA, he would be able to purchase the approved foreclosure with $100.00!!! That means that the standard 3.5% down payment is out the window on this approved HUD foreclosure.

It helps to work with an informed and experienced agent, wouldn't you agree? Mr. Out-of-Towner was grateful for the information since his agent was not aware of it.

Please note: Not all HUD foreclosures qualify for $100 down. HUD is responsible for marketing which properties qualify.

Buyer's Representation, Why

Scenario: You find a home you like. You call the agent on the sign (listing agent). You speak with the listing agent about purchasing the property.

Concerns: Who does the agent work for? Whose interest is the agent looking out for?

Answer: Not yours, but the seller that hired them.

Solution: Obtain your own representation. Is it not wise to have a buyer's agent that is working for you and looking out for your best interest, providing you details about the property, requesting additional information that may affect your real estate decisions? Think of it this way... two people are getting a divorce and splitting assets, would they use the same lawyer?

My topic of discussion along with the other panelists was to basically brag on the Coldwell Banker tools provided to the agents. Oh what a plethora of free tools that can be used! I was truly surprised though at how many agents do not have a website or keep their website updated. Realtors... take a look around... successful agents have successful websites, blogs, and other online networking tools. Remember, 90% of agents call themselves licensed but only 10% of agents work and thus called Top Producers. This is a business, your business. So treat it like one.

However the facts and trends report for Dallas County shows a downward trend from the same time period of August 2008 to August 2009 in the price range of $1,000,000 - $1,999,999. Properties pending have not changed, holding steady at zero. Properties sold at a decrease of 33.3%.

One of the items I will address in my speech at the International Business Conference (IBC) in October is to encourage real estate agents to update their photo online as well as their business cards. The 1980 glamour shot is OUT! The snap shot in the hallway is ineffective (and scary) and the Olan Mills still pose is typical. With 86% of people using the internet to shop for homes, don't you think those same people shop for real estate agents? If your picture isn't saying much, then the consumer won't expect much.

If you want to purchase a foreclosure property or a home being sold as-is, make sure your Realtor knows what will pass FHA guidelines if you are qualified for an FHA loan.

These are just a few of the items that an appraiser will look at when viewing the condition of the home:

All properties must meet HUD Minimum Property Requirements. Repairs required on properties should involve elements that affect the safety, sanitary and structural soundness of the property. Examples of such repairs include but are not limited to: inadequate access/egress from bedrooms to exterior of home; leaking or worn out roof; evidence of structural problems; cracked masonry or foundation damage; defective paint in interior and exterior of homes constructed before 1978; defective exterior paint on homes constructed after 1978 where finish is unprotected; missing appliances attached to property; termite and dry rot inspections (when infestation noted by appraiser); less than average condition of sheetrock/walls; inoperative or inadequate plumbing, heating or electrical systems; drainage problems.

A New Selling Technique - Reverse Offers

I constantly search for new ways to market and sell in our ever changing economy. I have successfully tried this new way and want to continue. But you, the seller, may have to open your mind a bit to make this a success.

A reverse offer takes place after a listing agent has a showing on one of her listings. If the potential buyers request a second showing—thus indicating enough interest for the listing agent to collect feedback from the buyer’s agent—then the listing agent discusses that feedback with the seller, who in turn writes up a “reverse offer.” The offer addresses any buyer concerns, such as the condition of the home’s carpet, which would be factored into the reverse offer in the form of an allowance. The offer is based on what the seller assumes the buyer is willing to pay for the property.

Sellers must be willing to put their offer on the table first!!
